Flowscape Terms & Conditions
Our end-customer and partner agreements.
The following terms and conditions described below govern the supply of Software, Products and Services from Flowscape to a Customer and/or Partner. The Agreement is entered into by i) Customer/partner sending a Purchase Order referencing the agreement, or ii) Customer/partner using the Software free of charge. Flowscape’s direct competitors are prohibited from accessing the software, unless Flowscape has given a written consent. Flowscape and Customer/partner are in the Agreement referred to as a “Party” and jointly as the “Parties”.

End Customer Agreement
General Terms
The following terms and conditions govern the supply of Software, Products and Services from Flowscape to a Customer. The Agreement is entered into by i) Customer sending a Purchase Order referencing the Agreement, or ii) Customer using the Software free of charge. Flowscape’s direct competitors are prohibited from accessing the software, unless Flowscape has given a written consent. Service Level Terms
In this Schedule the availability, maintenance and support of the Software is described. The Software shall be available all around the clock all days a year (usually described as 24/7). The Availability Level should be at least ninety-nine (99) percent measured during a calendar month, excluding the Planned Downtime. Read more here.
Data Processing Agreement
This data processing agreement (“Data Processing Agreement”) applies when Customer has
purchased Software directly from Flowscape. If no separate data processing agreement is entered between Flowscape and Customer this Data Processing Agreement is entered into by i) Customer sending a Purchase Order referencing the Agreement, or ii) Customer using the Software free of charge. If a separate data processing agreement has been entered by the Parties then that agreement will replace this SCHEDULE 3 - DATA PROCESSING AGREEMENT. Read more here.
Partner Agreement
General Terms
This Agreement will commence on the Commencement Date and will continue for 3 years (the “Initial Term”) unless terminated sooner in accordance with its terms. On expiry of the Initial Term, this Agreement will automatically renew for further 12 month periods until one party terminates by providing no less than 60 days written notice prior to the end of the current 12 month period. Service Level Terms
In this Schedule the availability, maintenance and support of the Software is described. The Availability Level should be at least ninety-nine (99) percent measured during a calendar month, excluding the Planned Downtime. If the Software does not perform according to the Agreement, actions shall be taken. Read more here.
End User License Agreement
This End User License Agreement applies when End User has purchased Software via a Partner rather than directly from Flowscape and no separate license agreement has been signed between End User and Flowscape. By receiving, downloading, opening the file package or using the Software, you are accepting the terms of this End User License Agreement. Data Processing Agreement
With reference to the Agreement, the Processor will have access to Personal Data for which the Controller acts in capacity of Controller, along with applicable legislation. The Parties hereby wish to supplement the Agreement with this DPA to formalize the terms and conditions applicable of the processing of Personal Data. The purpose of this DPA is to secure adequate safeguard with respect to the protection of privacy of individuals and to ensure that the processing of Personal Data is in accordance with the Controller´s and the Processor´s legal obligations.
